BATON ROUGE - Judge Gail Ray granted 30-day continuance this week for the trial of one of the men accused of raping Madison Brooks.

Desmond Carter, 21, is accused of raping 19-year-old LSU student Madison Brooks before she died hours later. He faces first-degree and third-degree rape charges.

District Attorney Hillar Moore confirmed that court is now set for Sept. 17, "at which time a trial date will be selected." It was previously set for Aug. 17, with the motion to vacate that trial date being submitted late Thursday afternoon.

The motion to continue the trial by the state accused the defense of making the state "spend every possible moment responding to their last-minute motions rather than prepare for trial."

"The State should not be forced to suffer for defense counsel's failure to adequately prepare," prosecutors said.

The defense responded, saying there "is no feasible explanation why the State should not be prepared after three and a half years of consistent litigation."

"...the State cannot be 'ambushed by its own evidence," the defense said.
